Privacy policy

Effective November 2, 2026

This policy explains how Fair Winds Assessment and Counseling Center (“Fair Winds,” “we,” “us”) handles personal information collected through www.fairwindsmentalhealth.com and related website interactions.

It covers the website only. Health information created or received in your care is governed by our Notice of Privacy Practices, not this policy.

We do not have a designated Data Protection Officer. If you have a privacy question or request, contact us using the details above and we will route it to the right person.

Scope

This policy applies to people who visit our website, call or email us, use our website contact form, or ask us to schedule an appointment. It does not apply to:

  • The patient portal and practice management system. Scheduling, intake forms, secure messaging and billing take place in SimplePractice, which has its own privacy policy.
  • Payment and financing sites. Quick pay is handled by Helcim, and financing is handled by CareCredit. Their privacy policies apply when you use those services.
  • Clinical records. Our Notice of Privacy Practices explains how we use and protect protected health information.

Information we collect

Information you give us

  • Contact form. If you send us a message, we receive your name, phone number, best time to call, topic and any short note you choose to include. Please do not include health details, diagnoses or records. The form is not a secure clinical channel.
  • Calls, voicemail and email. We receive the phone number, email address and information you choose to share when you contact us.
  • Appointment requests. We receive the details you provide when you request an appointment. Scheduling and intake are completed in our secure patient portal.

Information collected automatically

  • Hosting and security. Our host, Cloudflare, processes technical information such as IP address, browser and device type, requested pages, and security events so the site can load and stay protected.
  • Analytics, only with your permission. If you choose Allow analytics, Google Analytics receives information such as the pages you view, your browser and device type, interactions with the site, and an approximate location derived from your IP address. We disable Google signals and ad personalization, and we deny advertising storage.
  • No advertising trackers. We do not use advertising pixels, social media trackers, session recording, or cross-site behavioral advertising on this website.

Information from service providers

If you are a client, our practice management system may hold your contact details, appointment information and secure messages so we can provide care. Payment and financing providers may confirm a payment or application you chose to make. We do not buy personal information from data brokers.

How we use information

We use website information to:

  • Respond to your inquiry and help you request an appointment.
  • Coordinate scheduling and care through our practice management system.
  • Send service communications such as appointment reminders, secure messages and billing notices. These are not marketing messages.
  • Protect the website, prevent spam and abuse, and troubleshoot problems.
  • Understand which pages are useful, but only through analytics you have allowed.
  • Comply with legal obligations and enforce our Terms of use.
  • Send a newsletter only if you opt in. Every newsletter will include an unsubscribe link. If we add a newsletter, the signup form will identify the email provider then in use.

We do not use website information for automated decision-making or advertising profiles.

Where data protection law requires a legal basis, we rely on:

  • Consent for Google Analytics and any newsletter.
  • Legitimate interests for keeping the site secure, responding to inquiries and operating the website.
  • Steps before entering a contract when you ask us to schedule an appointment.
  • Legal obligation where we must keep or disclose information.

You can withdraw consent at any time using Privacy choices at the bottom of every page.

When we share information

We do not sell personal information, and we do not share it for cross-context behavioral advertising or data-broker purposes.

We share information only with service providers that help us run the website and practice:

We may also disclose information when required by law, when necessary to protect someone’s safety, or as part of a merger, sale or transfer of the practice. If a transfer happens, we will give notice and obtain consent where required.

Service providers must protect the information and may use it only for the services they provide to us.

Cookies and tracking

We use a small number of cookies and browser storage. Analytics is off until you allow it. Essential storage remembers your choice and helps keep the site secure.

  • Essential: your consent choice, Cloudflare security cookies, and Cloudflare Turnstile if the contact form is enabled.
  • Analytics: Google Analytics cookies, only after you choose Allow analytics.
  • Advertising or targeting cookies: none.

If your browser sends a Global Privacy Control signal, we treat it as a “no” and analytics stay off. You can change your choice at any time using Privacy choices in the footer.

Our Cookie policy lists the cookies we use, their purposes and how to manage them.

How long we keep information

  • Website inquiries are kept as long as needed to respond and for our business records, then deleted or archived under our retention practices.
  • Analytics is retained according to our Google Analytics settings and used in aggregate.
  • Consent choices are stored in your browser for up to 12 months.
  • Clinical records are kept as described in our Notice of Privacy Practices and applicable law.

Security

We use HTTPS, HSTS, a content security policy, access controls and spam protection. No method of transmission or storage is completely secure. Please do not send health details, diagnoses, records or other sensitive information through the website, ordinary email or text message. Use the patient portal or call us instead.

If we learn of a breach affecting website information, we will notify affected people and authorities as required by law.

Your privacy rights

Depending on where you live, you may have the right to:

  • Access the personal information we hold about you.
  • Correct information that is inaccurate or incomplete.
  • Delete information, subject to legal and recordkeeping requirements.
  • Restrict or object to some processing.
  • Receive a portable copy of information you provided.
  • Withdraw consent for analytics or a newsletter.
  • Be free from discrimination for exercising your rights.
  • Complain to a privacy regulator.

California residents also have the right to know what categories of personal information we collect and why, to delete it, to correct it, to limit the use of sensitive personal information, to opt out of sale or sharing, and to be free from retaliation. We do not sell or share personal information for cross-context behavioral advertising.

Texas residents may have rights under the Texas Data Privacy and Security Act, including access, correction, deletion, portability, and opting out of sale, targeted advertising or profiling. We do not sell website information or use it for targeted advertising.

Residents of other states with comprehensive privacy laws may have similar rights. We will honor requests as required by applicable law.

To make a request, email info@fairwindsmentalhealth.com or call 817-735-4165. We may need to verify your identity before acting. An authorized agent may submit a request with proof of authority.

Appeals. If we deny a request, you may appeal within 60 days by email or phone. Include your original request, the date of our response, and why you believe our decision was wrong. We will review the appeal and respond as required by law.

Complaints. Contact us first so we can help. You may also contact your state attorney general or the privacy regulator where you live. For health information, our Notice of Privacy Practices explains how to contact the U.S. Department of Health and Human Services Office for Civil Rights.

Children’s privacy

Our website is written for parents, guardians and adults. We do not knowingly collect personal information from children under 13 through the website without verifiable parental consent.

Clinical services for children are arranged by a parent or guardian through our office or patient portal, not by a child submitting a website form. If you believe a child has sent personal information through the website, contact us and we will delete it. A parent or guardian may also contact us to review, update or delete website information about their child.

International transfers

We are in the United States. Our service providers may process information in the United States and other countries. Where required, we use contractual and organizational safeguards for those transfers.

Our site links to the patient portal, payment and financing sites, Google Maps, our Google business listing and Facebook. Those sites have their own privacy policies, and we are not responsible for their content or practices.

Marketing and communications

We do not send marketing emails or text messages unless you opt in. Appointment reminders, secure messages and billing notices are service communications, not advertising.

If we add an email newsletter, you will be asked to opt in, the signup will identify the email provider, and every message will include an unsubscribe link. You can opt out at any time. We do not use website information for ad targeting or retargeting.

Changes to this policy

We may update this policy as our website or services change. We will post the new effective date at the top of this page. If a change is material, we will highlight it or ask for consent where the law requires.
